1. GENERAL INFORMATION
These terms and conditions govern the contractual relationship between Machu Picchu Wayna (hereinafter “the Agency”) and the client (hereinafter “the Client”) for the provision of tourist services in the city of Cusco and its surroundings.
By contracting any of our services, the Client expressly accepts these terms and conditions in full.
2. SERVICES OFFERED
The Agency offers tourism services that include, but are not limited to:
- Guided tours to Machu Picchu and the Sacred Valley
- Excursions to archaeological sites in Cusco and surroundings
- Tourist transportation
- Booking of entrance tickets to tourist attractions
- Accommodation reservations
- Professional tour guide services
- Customized tour packages
3. BOOKINGS AND CONFIRMATION
3.1. Bookings can be made through our website, email, phone, or in person at our offices.
3.2. Every booking requires a minimum advance payment of 50% of the total service value to be confirmed.
3.3. The Agency reserves the right to confirm the availability of the requested services within a maximum of 24 hours.
3.4. The Client must provide complete and accurate information at the time of booking, including full names, passport number, age, nationality, and contact details.
3.5. The booking confirmation will be sent by email and will include the details of the contracted service.
4. PAYMENT CONDITIONS
4.1. Deposit: An initial payment of 50% is required to confirm the booking.
4.2. Balance: The remaining balance must be paid at least 72 hours before the start of the service.
4.3. Accepted payment methods:
- Bank transfer
- Deposit into account
- Cash payment (Peruvian soles or US dollars)
- Credit/debit cards (subject to bank fees)
- Online payment platforms
4.4. Prices are expressed in US dollars (USD) or Peruvian soles (PEN) as indicated.
4.5. Prices may be subject to change without prior notice due to variations in third-party rates (entrances, transportation, etc.).
5. CANCELLATION AND REFUND POLICY
5.1. Cancellations by the Client:
- More than 30 days before: 80% refund of the amount paid
- Between 15 and 30 days before: 50% refund of the amount paid
- Between 7 and 14 days before: 25% refund of the amount paid
- Less than 7 days before: No refund
5.2. Special cancellations: For Machu Picchu tours, due to strict ticket policies, cancellations made less than 15 days in advance will not be refunded.
5.3. All cancellation requests must be submitted in writing to info@machupicchuwayna.com
5.4. Refunds will be processed within a maximum of 15 business days.
5.5. Cancellation by the Agency: If the Agency cancels the service for reasons attributable to it, 100% of the amount paid will be refunded.
6. MODIFICATIONS
6.1. Any modification to dates, services, or number of people must be requested in writing.
6.2. Modifications are subject to availability and may incur additional charges.
6.3. Changes made less than 7 days in advance may result in penalties equivalent to 25% of the service value.
7. AGENCY RESPONSIBILITIES
7.1. The Agency is committed to providing the contracted services with the expected quality and professionalism.
7.2. Provide professional, licensed tour guides fluent in the agreed language.
7.3. Coordinate transportation, entrance tickets, and services included in the contracted package.
7.4. The Agency is not responsible for:
- Loss, theft, or damage of personal belongings during tours
- Accidents, injuries, or illnesses resulting from the Client’s pre-existing conditions
- Delays or cancellations caused by third parties (airlines, railways, etc.)
- Force majeure or unforeseeable circumstances
7.5. The Agency has civil liability insurance as required by Peruvian regulations.
8. CLIENT RESPONSIBILITIES
8.1. Arrive punctually at the established meeting points.
8.2. Carry valid identification (passport or ID) throughout the tour.
8.3. Follow the guide’s instructions and respect the rules of the sites visited.
8.4. Inform about any medical conditions, allergies, or physical limitations prior to the service.
8.5. Purchase personal travel insurance (recommended).
8.6. Respect cultural and natural heritage as well as local customs.
8.7. The Client will be responsible for any damage caused to third-party property or cultural heritage.
9. TRAVEL DOCUMENTATION AND REQUIREMENTS
9.1. It is the Client’s responsibility to verify and obtain the necessary travel documents (visas, vaccines, etc.).
9.2. To enter Machu Picchu, the original passport or ID used in the booking is required.
9.3. Students requesting discounted admission must present a valid university ID card with a photo.
10. HEALTH AND SAFETY CONDITIONS
10.1. Cusco is located at 3,400 meters above sea level. Prior acclimatization is recommended.
10.2. The Client must inform of any medical condition that may affect participation in the activities.
10.3. The Agency reserves the right to deny participation to individuals whose physical or health condition represents a risk.
10.4. We recommend purchasing travel medical insurance.
11. FORCE MAJEURE
11.1. The Agency will not be responsible for breaches arising from force majeure circumstances, including but not limited to:
- Natural disasters (earthquakes, floods, landslides)
- Social conflicts, strikes, or road blockades
- Health emergencies
- Government decisions
- Extreme weather conditions
11.2. In such cases, the Agency will offer viable alternatives or rescheduling of the service.
12. PERSONAL DATA PROTECTION
12.1. The Agency is committed to protecting the Client’s personal information in accordance with Peruvian Law No. 29733 on Personal Data Protection.
12.2. The provided data will be used solely for the provision of the contracted service and related communications.
12.3. The Client has the right to request access, updating, correction, or deletion of their data.
13. COMPLAINTS AND CLAIMS
13.1. Any complaint or claim must be submitted in writing to info@machupicchuwayna.com within 48 hours after the service.
13.2. The Agency commits to responding within a maximum of 5 business days.
13.3. The Client may submit their claim to INDECOPI if they believe their consumer rights have been violated.
14. MINORS
14.1. Minors under 18 years old must travel accompanied by a responsible adult.
14.2. For minors traveling without their parents, a notarized authorization is required.
15. PHOTOGRAPHS AND AUDIOVISUAL MATERIAL
15.1. The Agency may use photographs and videos taken during tours for promotional purposes, unless the Client expressly objects.
16. JURISDICTION AND APPLICABLE LAW
16.1. These terms and conditions are governed by the laws of the Republic of Peru.
16.2. Any dispute will first be resolved through extrajudicial conciliation.
16.3. If no agreement is reached, both parties submit to the jurisdiction of the courts of Cusco, Peru.
17. ACCEPTANCE
By making a reservation and corresponding payment, the Client declares to have read, understood, and accepted these terms and conditions in full.
